Legal Notice
1. General Information
The information provided during training sessions, workshops, or within digital materials by the Conflict Management Institute (CMI) is for educational and informational purposes only. While we strive for accuracy and professional relevance, CMI makes no claims, promises, or guarantees about the absolute accuracy, completeness, or adequacy of the contents of our programs.
2. No Legal Advice
The Conflict Management Institute is a professional training organization. Participation in our programs and certifications—including but not limited to the HR Conflict Management & Resolution Certification (HRCMR), the Certified Workplace Mediation Specialist (CWMS), and the 40-Hour Basic Mediation Training—does not constitute legal advice or the establishment of an attorney-client relationship. Participants should consult with qualified legal counsel regarding specific legal issues, employment law, or state-specific statutory requirements.
3. Intellectual Property
All course materials, including but not limited to digital workbooks, Representative Practice Scenarios, tactical scripts, and proprietary training methodologies, are the sole intellectual property of CMI.
-
Proprietary Marks: The names HRCMR, CWMS, and the specific curriculum and structure of the 40-Hour Basic Mediation Training are protected professional marks of CMI.
-
Limited License: Participants are granted a personal, non-transferable, and non-exclusive license to use these materials for their own professional development.
-
Restrictions: Unauthorized reproduction, distribution, or commercial "re-teaching" of CMI’s proprietary curriculum is strictly prohibited without express written consent.
4. Professional Certification & Credentialing
Completion of CMI training programs signifies that a participant has met our specific educational and competency standards.
-
Credentialing Responsibility: For programs such as the 40-Hour Basic Mediation Training, CMI provides the necessary education to apply for credentials; however, it is the participant’s sole responsibility to ensure they meet all external requirements for state-specific licensure or board-specific credentialing (e.g., TMCA).
-
Attendance Standards: To maintain the integrity of our certifications, participants must adhere to all attendance policies, including mandatory on-camera presence for the duration of virtual sessions.
5. Limitation of Liability & Indemnification
CMI and its instructors shall not be held liable for any direct, indirect, or incidental damages arising out of the use or inability to use the techniques, scripts, or information taught in our programs.
-
Indemnification: By participating in CMI programs, you agree to indemnify, defend, and hold harmless CMI and its representatives from any claims, losses, or legal fees resulting from your use of the training materials or your conduct in professional practice following the program.
6. Virtual Participation & Recording Consent
Because CMI programs are conducted live and synchronously to meet professional standards, sessions may be recorded for administrative, quality assurance, or credentialing verification purposes. By participating, you consent to the appearance of your likeness and voice in such recordings for internal CMI use.
7. Technical Force Majeure
CMI utilizes industry-standard platforms for virtual delivery but is not liable for training interruptions caused by factors outside of our control, including but not limited to platform-wide outages, widespread internet failures, or individual participant connectivity issues.
8. Governing Law & Jurisdiction
This Legal Notice and all matters regarding CMI training programs shall be governed by and construed in accordance with the laws of the State of Oklahoma. Any legal action or proceeding relating to your access to, or use of, the program shall be instituted in a state or federal court in Tulsa County, Oklahoma.
9. Severability
If any provision of this Legal Notice is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this notice and shall not affect the validity and enforceability of any remaining provisions.
